COVID-19: Residential and Commercial Evictions Stayed in Maryland

As of March 30, 2020, the Circuit Court for Montgomery County, Maryland has issued an order which will stay or halt all residential and commercial evictions for at least fifteen (15) days. Pursuant to the Maryland Court of Appeals Order partially closing the Maryland Courts as well as Governor Hogan’s “Stay at Home” Order (issued March 30, 2020), the Montgomery County has decided that all residential and commercial evictions will be stayed. Essentially, the Court is attempting to stop landlords from obtaining evictions orders against both residential and commercial tenants while all businesses and people are dealing with the Coronavirus Pandemic. It is important to note that this Court order only stays the issuance of the “eviction order”; the order does not stay a landlord from beginning the eviction process, as Maryland Courts (including the Montgomery County Circuit Court) are still accepting pleadings and filings from parties (including eviction actions).
