Rockville Home Builder Sued by Maryland’s Attorney General

The Maryland Attorney General, Brian Frosh, is taking action against a Rockville home builder stating that in Maryland “home builders must be registered prior to entering into contracts with consumers and constructing their homes.” The Maryland Attorney General’s Consumer Protection Division filed a suit against Mitchell & Best Homebuilders LLC primarily because the home builder provided buyers with defective water infiltration homes, and the Rockville home builder has refused to fix the defective problems.

The Maryland Attorney General’s Office has claimed in its allegations that Mitchell & Best Homebuilders (1) entered into home building contracts with buyers containing wrongful waiver of warranties, (2) entered into home building contracts with buyers containing wrongful waivers of the home buyer’s rights to damages, and (3) failed to register with the Maryland Home Builder Registration Unit.

Specifically, against Mitchell & Best Homebuilders, Maryland Attorney General’s Consumer Protection Division is seeking (1) restitution, (2) damages and (3) civil penalties. The Attorney General’s Office, according to Brian Frosch, “will seek sanctions against builders who fail to provide consumers with the protections offered by registration with my office.” To address these allegations, on August 9, 2016, the Office of Administrative Hearings will hold a hearing related the Rockville home builder.
